Job Description: 

Job Summary

•    Possess technical knowledge of the legal landscape for SCSI
•    Lead and take responsibility for providing legal advice, guidance and support to business units and stakeholders on all legal matters relating to SCSI products
•    Maintain close relations with stakeholders including Compliance, Risk, CFO and SCSI business Heads to provide them with relevant legal advice, guidance and support
•    Promote a culture and practice of compliance with legal standards (including conducting business within legal and regulatory requirements)
•    Lead through example and build appropriate cultures and values
•    Help to embed and implement global legal standards for SCSI, taking into account regional/country related legal issues
•    Help to ensure that regulatory reform / changes are appropriately assessed within legal from a SCSI impact perspective and that any regulatory reform is appropriately escalated and managed

Business
•    Member of a team providing product related legal advice with respect to security broking, portfolio management and Margin funding other SCSI initiatives.
•    Provide transactional support to SCSI business having regard to the Group’s minimum standards and guidance for the relevant product(s) or service(s)
•    Work with product and other stakeholders to structure and define parameters for new products and initiatives, from a legal perspective
•    Implement global standards for legal matters in relation to all SCSI businesses, including positions on departures from standard clauses, and applying a consistent approach to manage legal issues
•    Identify and find ways to reduce legal risk emanating from SCSI business
•    Control the quality and cost of legal services provided by external law firms

Key Responsibilities

Processes
•    Assist in procuring appropriate forms of legal documents for transactions with adequate protections / mitigations and help management to determine the validity and enforceability of such legal documents under the laws of all relevant jurisdictions.
•    Drive improvements to existing documentation processes and improve on the existing legal document templates for SCSI business.

People & Talent
•    Promote clarity and understanding of SCSI Product documentation within SCSI teams, and if required, to conduct relevant training to SCSI deal team around documentation and legal processes.
•    Promote best practices across SCSI teams.

Risk Management
•    Act as Risk Control Owner for Legal Enforceability and Liability Risks arising in relation to SCSI transactions, as outlined under the Operational Risk Framework and associated policies and procedures.

Governance
•    Develop awareness and understanding of the regulatory framework in which the Bank (especially CM business) operates, and implement such learnings towards regulatory governance of the CM business.

Regulatory & Business Conduct
•    Display exemplary conduct and live by the Group’s Values and Code of Conduct
•    Take personal responsibility for embedding the highest standards of ethics, including regulatory and business conduct, across Standard Chartered.  This includes understanding and ensuring compliance with, in letter and spirit, all applicable laws, regulations, guidelines and the Group Code of Conduct.
•    Effectively and collaboratively identify, escalate, mitigate and resolve risk, conduct and compliance matters.

Other Responsibilities
•    Direct access to all the external lawyers and all Unit Heads of SCSI and Bank as a team member for  updating on day to day litigation and non litigation matters.
